Ending the Agony of Limbo: Putting Children First in Our Family Courts
Why We Must End the Courtroom Limbo.
For thousands of families across the UK, the legal system has become a source of secondary trauma rather than a path to resolution. The current state of our Family Courts is a national crisis, with backlogs leaving vulnerable children in a state of agonizing uncertainty for years.
At the heart of the Liberal Democrat mission is the protection of individual rights and the safeguarding of the most vulnerable. When a child’s living arrangements, safety, or future stability are at stake, every week of delay feels like a lifetime.
The Human Cost of Justice Delayed
Behind every statistic is a child waiting to know where they will live or a victim of domestic abuse seeking the protection of the law. As of late 2024, record backlogs meant that thousands of children were trapped in proceedings that had lasted nearly two years or more.
As Sarah Green, MP for Chesham and Amersham, recently highlighted in Parliament:
"Children shouldn’t have to wait years for Family Court decisions that affect their lives. Today, I pressed the Minister on how her Department will fix the backlog in the Family Courts and speed up decisions affecting children and vulnerable families."
Why the System is Failing
The Liberal Democrats believe the gridlock is a direct result of years of underfunding and short-sighted policy decisions:
The Legal Aid Gap: Drastic cuts to legal aid have led to an explosion of "litigants in person." Without professional representation, cases take significantly longer to process, clogging the system for everyone.
Infrastructure Neglect: Dilapidated court buildings and a lack of investment in modern IT systems have slowed administrative efficiency to a crawl.
Judicial Shortages: We are facing a critical shortage of judges and court staff, leading to hearing dates being pushed further and further into the future.
The Liberal Democrat Policy:
Rebuilding the Justice System
We believe the current gridlock is the result of years of neglect. To fix this, the Liberal Democrats are advocating for a "Fair Deal" for justice that moves beyond sticking-plaster solutions.
Our policy platform focuses on four key pillars:
Restoring Early Legal Advice and expanding mediation: We are calling for the reintroduction of legal aid for early advice in family cases. By helping parents understand their rights and options sooner, we can prevent cases from spiraling into lengthy, adversarial court battles.
Expanding access to non-adversarial dispute resolution to reduce the pressure on courts and find more harmonious outcomes.
Investing in "Law Start Centres": We propose rolling out community-based legal hubs in libraries and community centres. These would provide trained specialists to help families resolve legal problems before they ever reach a courtroom, saving the Treasury money and reducing the burden on judges. Alongside buildings, binging court technology into the 21st century to eliminate administrative bottlenecks.
Support for Domestic Abuse Victims: Liberal Democrat policy includes embedding domestic abuse specialists into the justice process and ensuring mandatory trauma training for staff, ensuring that the most vulnerable are not further harmed by the system meant to protect them.
Putting Children First
We cannot allow "justice delayed" to remain the status quo. The Liberal Democrats will continue to hold the Government to account, pushing for the investment needed to clear the backlog and modernise our court estate.
Our goal is simple: a justice system that is local, accessible, and—most importantly—fast enough to protect the childhoods currently being put on hold.
